JAKARTA, bipol.co – The unilateral dismissal hearing of PT. Tech Data Advanced Solutions entered the third session at the Central Jakarta District Court. This session’s agenda shows the defendant’s response.
Defendant’s attorney, Mr. Yanto Robert, asked the plaintiffs regarding the completeness of the special power of attorney to register the claim as of May 20, 2020. Therefore they have not prepared an answer.
“We have not prepared an answer because there are doubts. We carried out an inage (file review) to the Case Registrar on Thursday, May 14, 2020. It turns out that in the dossier, the power of attorney was not available,” Robert said at Central Jakarta District Court, Wednesday (20/5/2020).
Therefore the plaintiff does not have legal standing or legal standing requirements to file a lawsuit. Although the legal standing examination at the second trial was received by the judge.
“It means that they do not have a legal standing to file a lawsuit. The power of attorney compared to the plaintiff last week received by the presiding judge was a replacement power of attorney. What was replaced was not in the documents,” said Robert.
Another defendant’s legal counsel Edward Sinaga asked the panel of judges to order the plaintiff to complete the power of attorney for the purposes of the lawsuit.
“So because the legality was not fulfilled, we conveyed it to the panel of judges so that it was completed first, then we submitted an answer,” said Edward.
Meanwhile, the plaintiff’s attorney Ronny Asril explained that he had not yet completed the legal standing because the head of the company PT. Tech Data was abroad and obeyed the applicable rules.
“This depends on the government policy that is there because Covid-19 government institutions are also closed,” he said.
Chief Judge Al Bintang did not bother because administrative matters were the plaintiff’s responsibility. The judges also asked the plaintiff to complete the legal standing and the defendant prepared the answer.
“The court did not reach there. The trial resumed on Wednesday 10 June 2020,” said Chief Justice Al Bintang.
PT. Tech Data’s unilateral inaugural hearing on PT. Tech Data was held on April 29, 2020 but the company as the plaintiff was absent while four employees were present as defendants. Then the second trial was held last May 13 which was attended by both parties.*
